The Occupational Safety and Health Administration (OSHA) has announced a new enforcement program to identify and cite employers who fail to comply with the agency’s record-keeping requirements for workplace safety. This includes collecting data on workplace injuries and illnesses and recording them in the applicable documents.
Under the new enforcement program, OSHA will assess employers who have not reported any injuries or illnesses in the prior five years, even if these have occurred. If OSHA determines that there was an unjustified failure to report an injury or illness, it may impose a civil penalty up to $13,494 per occurrence. The program is part of OSHA’s efforts to reduce the number of workplace injuries and illnesses across the United States. By tracking and sharing information about workplace incidents, employers can identify patterns and areas of concern, enabling them to take steps to make their workplaces safer.
Under the Occupational Safety and Health Act of 1970, it is the responsibility of each employer to maintain accurate records of workplace injuries, illnesses, and fatalities. The records must be accessible to all workers, and employers should also submit their records to OSHA annually.
For employers, the program could significantly increase the cost of non-compliance. Not only could employers face hefty fines for not reporting an incident, but neglecting to report an injury or illness could also lead to additional investigations and penalties for other possible violations.
OSHA does not disclose the specific statistics or data on employers that are penalized for not reporting injuries. However, OSHA’s collection of data on recordable injuries and illnesses suggests that some employers are not reporting injuries or illnesses as they should. In fiscal year 2020, OSHA issued more than $31 million in penalties against employers for failing to accurately report and/or post injury and illness data.
